Terms & Conditions
These Terms govern access to KemyShopping, customer accounts and purchases through the website or connected KemyShopping applications.
1. Operator and agreement
The operator is identified on the Company Information page. The agreement includes these Terms, the order summary, the policies linked at checkout and any product- or promotion-specific terms clearly disclosed before purchase.
2. Eligibility
A user must have legal capacity to enter the transaction or act with valid consent from a parent, guardian or authorised representative. Age-restricted products may require lawful age or identity verification.
3. Marketplace structure
Products may be supplied or fulfilled by approved independent sellers. The seller is identified on the listing or order record. KemyShopping is the merchant of record unless another retailer is expressly identified on the product page, at checkout or on the invoice. The Marketplace Terms explain this structure.
4. Accounts and security
Account information must be accurate and kept current. The user must protect login details, OTPs and devices, must not share an account for fraud or abuse, and must notify KemyShopping promptly of suspected unauthorised access. KemyShopping may require verification before changing sensitive details or releasing an order.
5. Product listings
Listings must accurately state material features, price, stock, condition, seller, included items, restrictions, delivery information and warranty. Images may include contextual items; only items expressly listed as included form part of the order. Pre-owned and refurbished goods must be clearly identified and their material condition disclosed.
6. Prices, taxes and charges
Prices are in rand and include taxes that must legally be charged. Delivery and other material charges are displayed before submission. KemyShopping may correct an obvious material error before acceptance and will refund an affected payment if the order cannot lawfully be fulfilled at the displayed terms.
7. Placing and accepting an order
The customer can review and correct checkout information before submission. An automated receipt acknowledges the request. Acceptance occurs after payment and required stock, seller, address and risk checks, when KemyShopping confirms processing or acceptance. Separate items may be accepted or cancelled independently.
8. Payment
The Payment, Pricing & Security Policy applies. The customer must use an authorised checkout method and comply with the selected provider's lawful terms. Off-platform payments to sellers or drivers are prohibited.
9. Delivery and collection
The Shipping & Delivery Policy applies. The customer must supply complete delivery information and ensure that an authorised person can accept the parcel. A secure handover may require a PIN, QR scan, signature, identity check or other proof.
10. Cancellations, returns and warranties
The Cancellation Policy, Returns & Refunds Policy and Warranty Policy form part of the agreement and operate alongside statutory rights.
11. Promotions, coupons and credits
Promotions may have stated dates, stock, product, customer, minimum-spend and redemption limits. They may not be duplicated, manipulated, sold or used fraudulently. A discount is recalculated fairly if part of an order is cancelled or returned.
12. Reviews and user content
A review must reflect genuine experience and must not be unlawful, deceptive, abusive, defamatory, infringing, promotional spam or disclose another person's private information. The user grants KemyShopping a non-exclusive licence to display and moderate submitted content for marketplace purposes. Genuine criticism is not removed merely because it is negative.
13. Acceptable use
Users may not interfere with the platform, bypass security, scrape personal information, deploy malicious code, make fraudulent orders or claims, misuse promotions, impersonate another person, manipulate ratings, harass customers or sellers, or use the service for unlawful trade.
14. Intellectual property
KemyShopping branding, platform design and original content are protected by applicable intellectual-property law. Product brands and seller content remain the property of their owners or licensors. Access grants only a limited right to use the platform for its intended shopping or seller purpose.
15. Privacy
Personal information is processed under the Privacy & POPIA Notice and Cookie Policy. Payment, delivery and seller partners receive only the information reasonably required for their role.
16. Platform availability and third-party services
KemyShopping aims to keep services accurate and available but maintenance, provider outages and events outside reasonable control can interrupt access. Links, payment providers, couriers and seller-supplied content may be governed by additional terms. KemyShopping remains responsible where law or the customer agreement makes it responsible.
17. Liability
Nothing excludes liability, rights or remedies that cannot lawfully be excluded, including applicable liability for gross negligence, unsafe goods or consumer remedies. Subject to that rule, a party is not liable for indirect loss that was not reasonably foreseeable from the transaction. Any limitation is interpreted narrowly to preserve mandatory rights.
18. Suspension and termination
KemyShopping may restrict or close an account where reasonably necessary for fraud, security, unlawful activity, repeated material breach or protection of users. Where circumstances permit, the user will be told the reason and given an opportunity to respond. Existing orders, refunds, warranties, payment obligations and lawful records continue as required.
19. Complaints, law and jurisdiction
Contact support@kemyshopping.co.za first so KemyShopping can investigate. South African law governs the agreement. A customer may approach an appropriate ombud, regulator, tribunal or court and is not required to give up a statutory forum.
20. Changes and general provisions
Material changes apply prospectively and are published with a revised review date. Existing orders remain governed by the terms accepted for that order unless law requires otherwise. If a provision is invalid, the remaining provisions continue. Failure to enforce a right once is not a permanent waiver. A user may not transfer an account or agreement without consent where consent may lawfully be required.
